Terms of Service

1. Agreement to Terms

By accessing or using RentDesk ("the Platform"), provided by Kuba Technologies (Pty) Ltd, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform.

2. Description of Service

RentDesk is a cloud-based property and rental management software platform designed for rental agencies, landlords, and tenants. Features include property management, tenant onboarding, lease management, payment tracking, maintenance management, inspection scheduling, document management, and reporting.

3. Eligibility

You must be at least 18 years of age and legally capable of entering into contracts under South African law. By registering, you warrant that you meet these requirements.

4. Account Registration

• You must provide accurate, current, and complete registration information.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorised access to your account.
• You are responsible for all activity that occurs under your account.
• Each user account is for individual use only and must not be shared.

5. Subscription and Billing

• RentDesk is offered on a subscription basis with Starter, Growth, and Pro tiers.
• Subscriptions are billed monthly in South African Rand (ZAR).
• Payments are processed through authorised third-party payment providers.
• Subscriptions automatically renew unless cancelled prior to the renewal date.
• We reserve the right to modify pricing with reasonable notice to subscribers.
• Refunds are subject to our refund policy and applicable consumer protection legislation.

6. Acceptable Use

You agree to use RentDesk only for lawful purposes and in accordance with these Terms. You must not:

• Use the Platform for any illegal, fraudulent, or unauthorised purpose.
• Upload false, misleading, or inaccurate information.
• Attempt to gain unauthorised access to any system, data, or user account.
• Reverse engineer, copy, or replicate the Platform's functionality.
• Violate any applicable South African or international laws.
• Infringe the intellectual property rights of Kuba Technologies or third parties.

7. Data Responsibility

As a user (particularly rental agencies), you remain the responsible party for personal information uploaded to RentDesk under POPIA. You warrant that you have obtained all necessary consents and lawful grounds for uploading third-party personal information. Kuba Technologies acts as an operator/processor in respect of this data.

8. Intellectual Property

All intellectual property rights in RentDesk, including but not limited to software, design, logos, trademarks, and content, are owned by Kuba Technologies (Pty) Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for its intended purpose during your active subscription.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Kuba Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform. Our total liability shall not exceed the amounts paid by you to us in the 3 months preceding the claim.

10. Service Availability

We endeavour to maintain high availability of the Platform but do not guarantee uninterrupted access. We reserve the right to perform maintenance, upgrades, or suspend access for security, technical, or operational reasons with reasonable notice where practicable.

11. Termination

We reserve the right to suspend or terminate your account if you breach these Terms, fail to pay subscription fees, engage in fraudulent or illegal activity, or for any other legitimate operational reason. Upon termination, your access to the Platform will cease, subject to applicable data retention obligations.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts, with preference given to the Western Cape High Court.

13. Changes to Terms

We may update these Terms periodically. Material changes will be notified to users via email or in-platform notifications. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
